The African Commission on Human Peoples’ Rights (the African Commission) meeting at its 45th Ordinary Session in Banjul, The Gambia from 13 - 27 May 2009:
Conscious of its mandate under the African Charter on Human and Peoples’ Rights (the African Charter) to promote and protect human and peoples’ rights in Africa;
Aware of the vital role of its Secretariat in ensuring the effective discharge of its mandate and the importance of having an effective Secretariat;
Further conscious of the difficulties the African Commission has had in the preparation, presentation and execution of its budget, and desirous of facilitating its budgetary preparation process;
Welcoming the decision of the Executive Council of the African Union to strengthen the human resources capacity of the African Commission through the recruitment of 33 more staff over the next five years;
Recalling the decision at its 6th Extra Ordinary Session to establish an Advisory Committee to work with the Secretariat to prepare the Programs budget of the Commission;
Hereby resolves to:
a) Establish an Advisory Committee on Budgetary and Staff Matters (Advisory Committee) with the following mandate:
- To work with the Secretariat to identify activities from the 2008 – 2012 Strategic Plan of the ACHPR that would feature in the Commission’s budget Proposals;
- To work with the Secretariat to prepare the programs budget of the African Commission for presentation to the relevant Organs of the African Union;
- To work with the Secretariat to ensure proper execution of the programs; and
- To work with the Secretariat on the implementation of the approved new structure of the Secretariat of the African Commission
b) Appoint the following to the Committee:
- Commissioner Musa Ngary Bitaye
- Commissioner Kayitesi Zainabo Sylvie
- Commissioner Reine Alapini-Gansou
- the Secretary to the Commission (ex-officio)
- one Senior Legal Officer (ex-officio)
- the Administrative and Finance Officer (ex-officio)
Further resolves that:
c) The Advisory Committee shall work in conformity with these terms of reference, the Rules of Procedure of the African Commission, the provisions of the African Charter on Human and Peoples’ Rights and the relevant African Union Rules and Regulations;
d) The Advisory Committee shall report at the Ordinary Sessions of the Commission on the implementation of this Resolution;
e) The Advisory Committee is established for an initial period of two years.
