Introduction
Reporting obligations (Article 62)
1. The Republic of Tunisia (Tunisia) is a State party to the African Charter on Human and Peoples’ Rights (the African Charter), ratified on 16 March 1983.
2. In accordance with Article 62 of the African Charter, Tunisia submitted its Initial Periodic Report to the 7th Ordinary Session of the African Commission on Human and Peoples’ Rights (the Commission), held from 18 to 28 April 1990 in Banjul, The Gambia.
3. Subsequently, the 1st Periodic Report was reviewed by the Commission at its 18th Ordinary Session, held in Cabo Verde from 2 to 11 October 1995 and the 4th to 9th Periodic Report at its 42th Ordinary Session, held from 14 to 28 November 2007 in Brazzaville, Congo. The relating Concluding Observations were adopted at the same Session.
4. In March 2025, the Republic of Tunisia submitted to the African Commission its 10th to 18th combined Periodic Report under the African Charter on Human and Peoples' Rights (2006-2024) and its Initial Report under the Protocol to the African Charter on the Rights of Women Africa – Maputo Protocol (2018-2024)1.
5. The Report was reviewed on 25 and 27 October 2025, in the framework of the 85th Ordinary public Session of the Commission, held in Banjul, The Gambia, from 21 to 30 October 2025.
6. A high-level Tunisian Delegation2, led virtually by H.E. Mohamed Ali NAFTI, Minister of Foreign Affairs, Migration and Tunisians Abroad, represented the State Party during the review, which led to a frank and constructive dialogue with the Commssion's Members.
7. Following the interactive dialogue, the Tunisian Delegation undertook to provide further information to the Commission at a later stage. A written contribution was indeed submitted on 1 December 20253.
8. The Report under consideration reflects the progress made by Tunisia in the promotion and protection of human rights during the period under review. The concluding observations contained in the present document reflect the positive aspects and factors limiting the enjoyment of human rights in Tunisia and highlight the sources of concern identified during the consideration of the Report and the additional information provided subsequently.
9. Finally, the Commission wishes to make recommendations to Tunisia on measures to promote the enjoyment of human rights, in accordance with the African Charter, the Maputo Protocol and other relevant regional and international instruments.
Recommendation: Tunisia should continue its efforts to comply with the obligation to submit periodic reports, in accordance with Article 62 of the Charter and other relevant guidelines set out by the African Commission.
