The African Commission on Human and Peoples’ Rights (the Commission), meeting at its 86th Ordinary Session, held virtually from 23rd February to 9th March 2026,
Recalling its mandate of protection and promotion under Article 45 of the African Charter on Human and Peoples’ Rights;
Recalling also its Resolution ACHPR/Res.624 (LXXXII) 2025 on the Development of a Model Law on Criminalizing Torture in Africa;
Recalling further the absolute prohibition of torture and other cruel, inhuman or degrading treatment or punishment under international and regional human rights law, including the African Charter on Human and Peoples’ Rights and the Robben Island Guidelines;
Noting the objectives of Resolution ACHPR/Res.624 (LXXXII) 2025 to develop a comprehensive and practical Model Law to support States Parties in criminalizing torture in accordance with international standards;
Recognizing that additional time is required to complete the drafting process and ensure broad consultations with relevant stakeholders;
Concerned that the persistence of torture and related practices across the continent underscores the continued urgency and relevance of the Model Law initiative;
Decides to:
1. Extend the mandate for the Development of a Model Law on Criminalizing Torture in Africa for a further period of one (1) year, with effect from the date of expiry of the current mandate.
