On the occasion of the meeting of the Chairperson of the delegation of the African Charter on Human and Peoples’ Rights (ACHPR) to the 33rd Ordinary Assembly of the African Union (AU) with H.E. Moussa Faki Mahamat, the Chairperson of the AU Commission, the ACHPR presented its submission on the situations in Libya and the Sahel for addressing the human rights dimension of the situations. This submission has been made based on Article 19 of the PSC Protocol, the communique of the 866th session of the AU Peace and Security Council and ACHPR Resolution 332 and its accompanying ACHPR study on human rights in conflict situations.
It is to be recalled that the ACHPR issued a statement expresses its grave concern that parts of the continent, including notably Libya and the Sahel have witnessed rising incidents of violent conflicts in which civilians bear much of the brunt of the violence. ACHPR makes this submission in support of the AU effort, including the Peace and Security Council Heads of State and Government meeting on these situations scheduled for 8 February 2020.
In its submission, the ACHPR, as part of its human and peoples’ rights protection mandate under Article 45 of the African Charter on Human and Peoples’ Rights, urged measures to prevent violations of rights and international humanitarian law, to monitor and report on rights issues in conflict situations, and for the establishment of processes for investigation and accountability measures including reiterating investigation of the bombing in Libya of a centre where migrants were held and remedial measures, including provision of humanitarian assistance, medical and rehabilitation support for those affected by violence with particular attention to women and children.
