Decision of the Commission on the merits

226. In light of the foregoing, the African Commission on Human and Peoples' Rights:
(a) Finds that the Respondent State is in violation of article 5, 6 and 7(1) of the Charter.
(b) Finds that there is no violation of Article 7(2) of the Charter;
(c) Finds that there is no violation of Article 8 of the Charter;
(d) Requests the Respondent State to take measures to compensate the victim for the prejudice they suffered due to the unjustified prolonged detention, torture, agony and inability to make a living for 26 years;
(e) Requests the Respondent State to adopl all necessary measures in order to ensure compliance both in law and in practice with the Charter and the Principles and Guidelines on the Right to Fair Trial and Legal Assistance in Africa.
